By using the services provided by Wellscape, you explicitly acknowledge and confirm that you have read, understood, and agree to abide by these Terms of Use in their entirety. This agreement applies every time you access our services, irrespective of the device used. If you do not agree with any part of these Terms, you are not authorized to use our services and should cease all usage immediately.

1.2 SERVICES PROVIDED

Wellscape is a vibrant, inclusive platform that seamlessly connects wellness practitioners with individuals seeking an array of wellness services. Our platform facilitates the discovery of services that cater to your wellness needs. However, while we take immense pride in our expansive network of talented practitioners, it’s important to note that we do not supervise, direct, or control their services in any capacity. Therefore, we are not liable for the quality, timing, legality, failure to provide, or any other aspect whatsoever, of the services rendered by the practitioners listed on our platform.

1.3 DISCLAIMER OF LIABILITY

In choosing to use our services, you acknowledge and agree that such usage is entirely at your own risk. You understand and agree that Wellscape shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use of or inability to use our services, even if we have been advised of the possibility of such damages.

1.4 INDEMNIFICATION

You agree to indemnify and hold Wellscape, its directors, officers, employees, agents, and affiliates harmless from any and all claims, losses, liabilities, damages, costs, or expenses, including reasonable attorney’s fees, arising out of or in connection with your use of our services, your violation of these Terms of Use, or your violation of any rights of any third party, including the practitioners.

1.5 HEALTH DISCLAIMER

By using our services, you represent and warrant that you are in good health and have consulted with a healthcare professional about your intent to participate in any wellness activity. You understand and agree that the ultimate responsibility for determining your physical and mental fitness to participate in any wellness activity lies solely with you, regardless of any information or advice you may receive through the Wellscape platform.

1.6 INTELLECTUAL PROPERTY RIGHTS

All content present on the Wellscape platform, which includes, but is not limited to, text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the exclusive property of Wellscape or its content providers and is protected by international copyright laws. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the service, use of the service, access to the service, or content provided by Wellscape without express written permission by us. Wellscape’s trademarks may not be used in connection with any product or service that is not Wellscape’s, in any manner that is likely to cause confusion among customers or in any manner that disparages or discredits Wellscape.

1.7 DISPUTE RESOLUTION

Any disputes arising out of or in connection with these Terms of Use, including any questions regarding the existence, validity, or termination of these terms, will be referred to and finally resolved by arbitration in accordance with the Arbitration Rules of the applicable Arbitration Association, which rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one, the seat, or legal place, of arbitration shall be London, UK, the language to be used in the arbitral proceedings shall be English, and the governing law of the contract shall be the substantive law of the England.

1.8 PAYMENT TERMS

All fees applicable for the services on the Wellscape platform are stated in the respective service description. Payment can be made by the various methods detailed on the site, and payments need to be cleared in order for the services to be utilized. Fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties. Refunds for services are available and are governed by our Refund Policy, which is made available on our platform. We reserve the right to adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion.

1.9 ACCOUNT TERMINATION

Wellscape reserves the right to suspend or terminate your account and refuse any current or future use of the platform for any reason at any time. This includes the right to deactivate or delete your account and all related information and files in your account, and the forfeiture and relinquishment of all content in your account. Further, you agree that Wellscape shall not be liable to you or any third party for any suspension or termination of your access to the platform. Any suspected fraudulent, abusive, or illegal activity that may be grounds for termination of your use of the platform may be referred to appropriate law enforcement authorities.

1.10 AGE RESTRICTIONS

The services of Wellscape are available only to individuals who are at least 18 years old, unless we specify otherwise. No one under this age may access or use the platform or provide any personal information through the platform unless under the following condition: if you are between 13 and 17 years of age, you may use Wellscape only with the supervision and consent of a parent or guardian. Any registration, use or access to the services by anyone under 13 is unauthorized, unlicensed, and in violation of these Terms of Use.

2.1 These Terms of Use constitute the entire agreement between you and Wellscape and supersede all prior or contemporaneous understandings, agreements, communications, and proposals, whether oral or written, between you and Wellscape. If any provision of these Terms of Use is held by a court of competent jurisdiction to be invalid or unenforceable, such provision shall be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. Your continued use of our services after the effective date of such changes will constitute your acceptance of and agreement to such changes.
